Need to include the correct subtitles #1

I need subtitles, the mp4 files I have typically have 2 subtitle tracks, but one of them simply contains the chapter title ad nothing else. I did a test run to split the mp4 and the resulting files only had the chapter titles for the subtitle text. Can this be fixed to either include both subtitle tracks, or at least specify the correct one? One my test case, the correct one is track 1, while the chapter names show up on track 2. Thanks!
